Challenging a Denied Claim
When an employer or insurer denies a workers’ compensation claim, the injured employee may request a hearing with the Georgia State Board of Workers’ Compensation. An administrative law judge will consider the evidence and determine whether benefits should be awarded.

Filing Deadlines and Appeals
Georgia workers’ compensation cases are subject to strict deadlines. In many denied claims, the employee must file a Form WC-14 with the state board within one year of the workplace accident. Different deadlines may apply when the employee receives authorized medical treatment or weekly income benefits.
A denied claim and an appeal are not the same. An insurer’s initial denial is generally challenged by requesting a hearing. If an administrative law judge later issues an unfavorable decision, an application for review generally must be filed with the state board’s Appellate Division within 20 days.
